Mayor Jay Vavricek is expected to appear in Howard County court Wednesday morning after being arrested on suspicion of DUI in early March.

Howard County Attorney David Schroeder filed reckless driving charges against the Mayor Monday morning.

The Class III misdemeanor carries a possible penalty of three months in jail and or $500 dollars in fines.

Schroeder will not discuss why DUI charges are not being filed or the results for Vavricek's blood alcohol content.

A source with knowledge regarding legal cases tells News 5 the state does not have regulatory authority over County Attorney's. When and how they release information during an investigation is their own discretion.
