Omaha State Senator Scott Lautenbaugh was busted early Wednesday morning for driving under the influence.

Lautenbaugh was pulled over by the Douglas County Sheriff's Department around 2:00 Wednesday morning for erratic driving.

Preliminary test showed he had a blood alcohol level of .234. 08 is the legal limit.

In a statement Lautenbaugh said he is embarrassed and takes full responsibility for his actions.

Any legal proceeding stemming from his DUI will have to wait until June.

Nebraska state law dictated that a senator serving in the Unicameral cannot be prosecuted while they are in session.
