I have a spider like this one that returns to our garden every Summer. This bright yellow spider with the aliem looking markings is referred to as the common Garden Spider. They are not considered poisonous but can inflict a nasty bite that festers.

Of the 38,000 species of spiders it's hard to tell what this one is without a closer view, measurements, and perhaps observation of its nesting, feeding and reproductive habits. Nice specimen though.

Not common garden spider.I was bitten by a spider 3 yrs ago and almost died from infection from the bite.This a Hobo spider you have there.they are nasty,and they are called Hobo spiders because the "hitch a ride on your clothes into your house.

I can't believe I even clicked on this link! I hate spiders! We have some that look sort of like that living in our trees. Creepy!

We have those in our garden every year and sometimes on the railing of our porch. They are a bright yellow and black. Rather pretty.

it is not a hobo spider. they are commonly called writing spiders in my area. you can tell from the markings and the distinct x shape of their legs. http://en.wikipedia.org/wiki/Argiope_(spider)

Yeah I would say that this is not a Hobo spider either. We have Hobo spiders outside of our house and they are never hanging out on a web. They are always tucked just inside there funnel opening usually between boards or rocks.
